Acceptance of Terms

By downloading, installing, or using the PokyoPets mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and PokyoPets ("we", "us", "our"). By creating an account, you confirm that you have read, understood, and accepted these Terms in full.

These Terms apply to all users of the App, including visitors, registered users, and subscribers of Paw+ (our premium tier).

Eligibility

You must be at least 16 years old to use PokyoPets. If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian. By creating an account, you represent and warrant that you meet this age requirement.

PokyoPets is intended for dog owners and dog enthusiasts. You must own, co-own, or regularly care for a dog to maintain an active dog profile on the platform. Human-only profiles for community browsing are permitted on the free tier.

We reserve the right to request age verification at any time and to suspend accounts where eligibility cannot be confirmed.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at info@pokyopets.com of any unauthorised use of your account.

You may only create one account per person. Creating multiple accounts to circumvent suspensions or bans is prohibited and may result in permanent termination of all associated accounts.

You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.

Subscription Plans

PokyoPets offers the following plans:

PokyoPets reserves the right to introduce additional tiers, modify features within existing tiers, or discontinue a tier upon reasonable notice. Existing subscribers will not have features removed mid-billing cycle without compensation or credit.

Billing & Payments

All Paw+ subscriptions are processed exclusively through the Apple App Store (iOS) or Google Play Store (Android), depending on the platform you use to access PokyoPets. By subscribing, you agree to the billing terms of your respective app store.

Paw+ subscriptions are set to auto-renew by default. Your subscription will automatically renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date. You will be notified of upcoming renewals by Apple App Store or Google Play in accordance with their respective policies.

PokyoPets does not store, process, or have access to your payment card details. All payment data is handled solely by Apple or Google.

Cancellation & Refunds

You may cancel your Paw+ subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you will retain access to Paw+ features until that date.

Refund policy: PokyoPets does not issue refunds directly. All refund requests must be submitted to Apple App Store or Google Play, as applicable, and are subject to their respective refund policies. PokyoPets has no control over, and accepts no liability for, the outcome of refund requests made to app stores.

Annual subscriptions are non-refundable through PokyoPets. If you believe you are entitled to a refund, please contact Apple or Google directly.

If your account is terminated by PokyoPets for a serious violation of these Terms, no refund of any remaining subscription period will be issued.

User Content & Intellectual Property

By uploading, posting, or submitting any content to PokyoPets — including photographs, dog profiles, text, or any other material ("User Content") — you irrevocably assign and transfer full ownership of that User Content to PokyoPets.

This means that once content is uploaded to the App, PokyoPets becomes the sole owner of that content and may use, reproduce, modify, distribute, display, and create derivative works from it, worldwide, without further consent, notice, or compensation to you.

You represent and warrant that: (a) you own or have the necessary rights to upload the content; (b) the content does not infringe any third-party intellectual property rights; and (c) you have obtained consent from any identifiable persons depicted in photographs you upload.

The PokyoPets name, logo, brand, and all original platform content remain the exclusive intellectual property of PokyoPets. You may not copy, reproduce, or use our branding without prior written consent.

Acceptable Use

You agree to use PokyoPets only for lawful purposes and in a manner consistent with these Terms and our community standards. The following conduct is strictly prohibited:

Violations of these rules may result in immediate suspension or permanent termination of your account, at our sole discretion, without prior notice and without refund.

Intellectual Property of PokyoPets

All rights, title, and interest in and to the PokyoPets App — including but not limited to the software, design, interface, graphics, logos, text, and all original content created by PokyoPets — are and shall remain the exclusive property of PokyoPets.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the App for personal, non-commercial purposes. This licence does not include any right to sublicense, resell, or commercially exploit the App or its content.

Any feedback, suggestions, or ideas you submit to PokyoPets regarding the App may be used by us without restriction or compensation to you.

Disclaimers & Limitation of Liability

App provided as-is. PokyoPets is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or that the App will meet your specific requirements.

Real-world interactions. PokyoPets facilitates connections between dog owners but is not responsible for any in-person meetings, playdates, or interactions that arise from use of the App. You attend any real-world meetups at your own risk. PokyoPets makes no representations about the identity, behaviour, or intentions of other users.

Data loss & interruptions. We are not liable for any loss of data, loss of profits, or damages arising from service interruptions, technical failures, or downtime, regardless of cause.

Third-party services. The App integrates with third-party services including Google Firebase, Apple App Store, and Google Play. We are not responsible for the availability, accuracy, or conduct of these third-party services.

Liability cap. To the maximum extent permitted by applicable law, our total liability to you for any claims arising from or related to these Terms or your use of the App shall not exceed the total amount you paid to PokyoPets (via subscription) in the twelve (12) months immediately preceding the claim.

Account Termination

By you: You may delete your account at any time through the in-app settings or via our account deletion page. Upon deletion, your profile and content will be removed in accordance with our Privacy Policy.

By PokyoPets: We may immediately terminate or suspend your account, without prior notice or refund, if we determine in our sole discretion that you have committed a serious violation of these Terms. Serious violations include but are not limited to: posting illegal content, harassment of other users, animal cruelty content, impersonation, and using automated tools to scrape the App.

Upon termination for cause, any active Paw+ subscription will be cancelled immediately and no refund of the remaining subscription period will be provided.

Sections 7 (User Content), 9 (Intellectual Property), 10 (Disclaimers), 13 (Dispute Resolution), and 14 (Governing Law) shall survive termination of these Terms.

Changes to the Service & Terms

PokyoPets reserves the right to modify, update, or discontinue any feature of the App at any time. We may also revise these Terms at any time. Changes to the Terms or material changes to the App will be communicated to you via in-app notification.

Changes take effect immediately upon the in-app notification being displayed, unless otherwise stated. Your continued use of the App after a change notification constitutes your acceptance of the updated Terms or service modification.

If you do not agree to a material change, your sole remedy is to cancel your subscription and cease using the App. We will not be liable to you for any modification or discontinuation of the service.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of PokyoPets, the parties agree to first attempt to resolve the matter through good-faith negotiation.

Before initiating any legal proceedings, you must notify PokyoPets in writing at info@pokyopets.com describing the nature of the dispute and the remedy sought. PokyoPets will have 30 days from receipt of such notice to attempt to resolve the dispute informally.

If the dispute is not resolved within 30 days of the written notice, either party may pursue the matter through the courts as specified in Section 14.

Governing Law & Jurisdiction

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts of Tel Aviv-Jaffa, Israel. Both parties hereby consent to the personal jurisdiction of such courts.
